This timing is not coincidental; it is driven by the confluence of tightening government regulation on both environmental and energy efficiency fronts, which combine to make proactive investment an immediate commercial imperative.

The Imminent Refrigerant Phase-Down


The most pressing regulatory factor is the aggressive phase-down of high Global Warming Potential (GWP) refrigerants under the UK’s F-Gas Regulations. While the initial significant ban on certain high-GWP refrigerants in smaller air conditioning units came into effect in 2025, the overall quota for the supply of HFC refrigerants continues to be severely restricted.

Critically, for existing, older commercial air conditioning and heat pump systems that use refrigerants with a GWP of 2,500 or more, the use of virgin refrigerant for servicing and maintenance is set to be prohibited from January 2026.


This affects common, older refrigerants such as R-404A. While reclaimed or recycled refrigerants may offer a short-term reprieve, their supply will become increasingly scarce and expensive. Businesses relying on these older systems face the substantial risk of equipment failure that cannot be serviced cost-effectively, leading to prolonged downtime and the necessity of an emergency, often more expensive, replacement.


Installing a new system in 2026 allows businesses to transition immediately to future-proof, low-GWP refrigerants such as R-32, securing their operation for decades to come.

Meeting Stricter Energy Performance Standards


Alongside environmental controls, the regulatory landscape for property energy efficiency is rapidly changing. Under the Minimum Energy Efficiency Standards (MEES), commercial properties in England and Wales are now required to meet a minimum Energy Performance Certificate (EPC) rating of ‘E’. However, the government has ambitious targets to raise this standard significantly:


  • By 2027: The minimum EPC requirement is expected to rise to Band C.

  • By 2030: This is expected to rise further to Band B.


For the approximately 80% of commercial buildings in the UK that currently fall below a B rating, upgrading the Heating, Ventilation, and Air Conditioning (HVAC) system is one of the most effective ways to bridge this efficiency gap.


Modern, A-rated commercial air conditioning or heat pump systems offer vastly superior energy performance compared to older electric or inefficient boiler-based cooling. Investing in 2026 provides a three-year window to achieve the required Band C rating ahead of the 2027 deadline, avoiding the risk of a property becoming legally unlettable, which carries the threat of significant financial penalties.
